CONTEST OFFICIAL RULES & REGULATIONS

Eligibility:

Whistler Water’s “The Best Year Yet” contest is open to legal residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry, excluding Quebec.

Any entrant under the age of majority must have a parent or legal guardian sign on their behalf all necessary documentation in respect of this Promotion, including entry forms and releases. Void where prohibited.

The Promotion is subject to all applicable federal, provincial, territorial, municipal, and local laws and regulations.All employees or agents of the Sponsor, and their respective parents, affiliates, subsidiaries and agents, and any entity involved in the production, implementation, promotion, administration or fulfillment of the Promotion, and the individuals living in the same households of each of the above are ineligible to participate in the Promotion.

The “Sponsor” and “Administrator” is Whistler Water Inc.

Promotion Period:

Stage one (entry submission) of The Promotion will begin January 2nd at 6:00pm Pacific Standard Time (“PST”), and end at 11:59 p.m. PDT, January 21st. Stage two (voting period) will begin January 22nd at 10:00am and end at 11:59 p.m. PDT, January 29th, 2014 (the “Promotion Period”). The Administrator’s computer is the official time keeping device for this Promotion.

Limit of one (1) Entry per person. Entries received online shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Entry. For the purpose of these Contest

Rules, “authorized account holder” of an e-mail address is defined as the natural person who is assigned to

an e-mail address by an Internet access provider, on-line service provider, or other organization responsible

for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential

winner may be required to provide Sponsors with proof that the potential winner is the authorized account

holder of the e-mail address associated with the winning Entry.

Multiple Entries by the same person using one or more e-mail accounts shall result in disqualification. The Sponsor may use your entry to promote the current or future sweepstakes. Your entry will never be sold to third parties. All Entries

must be received no later than the end of the Contest Period. Entries will be declared invalid if they are

late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically

reproduced.

Voting/Winner Selection:

By participating in the voting portion of any contest, each voting participant agrees to be bound by the official contest rules. If an entrant receives multiple and/or irregular votes or multiple votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source, the organizer reserves the right to disqualify the entrant in its sole discretion. If the contest includes the use of an internet tool and the internet voting process fails to operate properly or appears to be tampered with or tainted with errors, fraud or unfair practices, the Sponsor reserves the right to use another means to determine the winner(s), i.e. random selection or appointing a panel of judges. All decisions of the judges are final.

Prizes:

Prizes will be awarded on January 30th, 2014. Winner(s) will be notified immediately online and instructed as to how the prize can be claimed. The All prizes must be accepted as awarded and are not transferable or convertible to cash. If no acknowledgement to claim prize has been given within ten (10) business days, an alternate winner will be chosen.

Conduct:

By participating in the contest, participants agree to be bound by the decisions of the Sponsor. Persons who violate any rule, gain unfair advantage in participating in the contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behaviour is prohibited. The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the contest and the Sponsor’s decisions concerning such disputes shall be final. If the conduct or outcome of the contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor. The Sponsor reserves the right to terminate this contest, or make such other decisions regarding the outcome as the Sponsor deems appropriate. All decisions will be made by the Sponsor and are final. The Sponsor may waive any of these rules in its sole discretion. Any attempt by an entrant or any other individual to deliberately circumvent, disrupt, damage or undermine the legitimate operation of this contest is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek civil and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law.

Content Ownership:

As a condition of entry, entrants warrant and represent that the Photo

A. is original to and that the entrant has all necessary rights (including, without limitation, consent of the photographer) in and to the Photo to enter the Contest;

B. does not violate any law, statute, ordinance or regulation;

C. does not contain any reference to or likeness of any identifiable third parties;

D. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:

i. Nudity;

ii. Explicit, graphic or excessive sexual activity;

iii. Crude, vulgar or offensive language and/or symbols;

iv. Derogatory characterizations of any ethnic, racial, sexual or religious groups;

v. Content that endorses, condones and/or discusses any illegal, inappropriate or high risk activity, behaviour or conduct;

vi. Personal information of individuals, including, without limitation, names and addresses (physical or electronic);

vii. Conduct or other activities in violation of these Contest Rules;

viii. Commercial messages, comparisons or solicitations for products or services;

ix. Any identifiable third party products and/or trade-marks, brands or logos. For
example, any clothing worn by you in your Photo must not contain any visible
logos, trade-marks or other third party materials; and

x. Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Contest Sponsors in its/their sole discretion.

E. By entering the Contest entrants confirm that he/she owns all intellectual property rights in the entry Photo,

including copyright in the Photo, including publication and duplication rights, confirms that he/she grants

the Contest Sponsors a worldwide, perpetual, royalty-free licence to reproduce and to distribute the Photo

digitally and only in relation to the contest or future promotions and confirms that he/she waives all moral

rights in respect of the Photo. The entrant releases the Contest Sponsors from any claims arising from the

distribution of the Photo digitally now or hereafter created. All Photos and entries submitted become the

property of the Contest Sponsors, who reserve the right to refuse any Photo submission or entry.
