CONTEST OFFICIAL RULES & REGULATIONS
Whistler Water’s “Experience Whistler” Contest (The Promotion) is open to legal residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry, excluding Quebec.
The Promotion is subject to all applicable federal, provincial, territorial, municipal, and local laws and regulations. All employees or agents of the Sponsor, and their respective parents, affiliates, subsidiaries and agents, and any entity involved in the production, implementation, promotion, administration or fulfillment of the Promotion, and the individuals living in the same households of each of the above are ineligible to participate in the Promotion.

Agreement to Official Rules:
By participating in the Promotion, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Promotion.
The Promotion will begin May 16th, 2015 at 12:01am PDT (“Pacific Daylight Time”) and ends on September 30th, 2015 at 11:59pm PDT. The Administrator’s computer is the official time keeping device for this Promotion.
How to Enter:
Purchase a Whistler Water 500mL flat-cap product with a Promotion label, check for the black 10-digit under-cap code.
Text the 10-digit code to: 1.877.996.1499
Limit of one (1) Entry per unique cap code. Each text message sent or received may incur a charge as provided in your rate plan. Message and data rates may apply.
Locations: Whistler Water is available at a variety of retail locations in British Columbia, Alberta, Saskatchewan, Manitoba, Ontario and Atlantic Canada.
The Sponsor may use your entry to promote the current or future sweepstakes. Your entry will never be sold to third parties. All Entries must be received no later than the end of the Promotion Period. Entries will be declared invalid if they are late, illegible, incomplete, from a mobile number that is no longer registered/available, damaged, irregular, mutilated, forged, garbled.
Includes: a $1,000 Flight Centre voucher, a $500 Visa Gift Card, transfers from Vancouver to Whistler courtesy of Imperial Limousine Service ($1,000 value), 3-nights of accommodation courtesy of Pan Pacific Whistler, a dinner tasting menu for two courtesy of Araxi restaurant (approximate value $200).
Prize value: at least $3,000 (note: value of prize may vary depending upon time of hotel booking/visit to Whistler, BC).

No substitution, exchange or transfer of prize by any winner. Sponsor reserves the right to substitute a prize for one of equal or greater value. Each prize winner is responsible for all taxes and fees, if any, associated with prize receipt and/or use. Limit: One (1) prize per person.
No Purchase Entry:
To enter without purchase a participant can mail a legibly handwritten entry, including: first and last name, street address, city, province, and postal code, telephone number and email address (where possible) to: Whistler Water “Experience Whistler” Summer Promotion, P.O. Box 1400, Whistler, BC, Canada V0N 1B0. DO NOT SEND ANY COMMENTS OR QUESTIONS TO THIS ADDRESS. One entry will be processed in response to each mail-in request that complies with the requirements of the Official Rules, up to a maximum of five (5) entries. Mail-in requests must be handwritten. Outer envelope must include a return address in the upper left hand corner that matches the requestor’s street address, and must be postmarked no sooner than May 16, 2015 and no later than September 30, 2015, and received by Sponsor no later than October 5, 2015. If the Promotion is extended beyond September 30, 2015, these dates are subject to a corresponding extension. Each entry must be mailed in a separate outer mailing envelope. Requests that are sent in business reply envelopes, that utilize address labels or stickers (for any address), that are photocopied, hand-stamped, computer-generated or otherwise mechanically or digitally produced or reproduced, that are not mailed in separate outer stamped mailing envelopes, or that otherwise fail to comply with the Official Rules, will NOT be honored or acknowledged.
In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but, not limited to, fraud, virus or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (b) cancel the Promotion and award the prizes in a random drawing from among all eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotoion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Prize Draw Selection:
Whistler Water’s “Experience Whistler” prizes will be awarded based on a random draw on or around October 6, 2015. Potential winners will be notified on or around October 9, 2015via telephone or text message. Each potential winner will be required to provide the Administrator a mailing address (no P.O. Boxes) for prize fulfillment purposes within 5 days of the date notice or attempted notice is sent, in order to claim his/her prize and to fulfill any such other requirements as determined by Administrator. Before a winner can be declared, each selected entrant must first correctly answer, unaided, a time-limited, arithmetic, skill-testing question to be administered in person or online. If any potential winner cannot be contacted, fails to answer the skill-testing question correctly or fails to provide address information, or if prize is returned as undeliverable, he/she forfeits the prize. In the event that a potential winner is disqualified for any reason, Administrator may award the applicable prize to an alternate winner in a random drawing from among all remaining eligible entries. Only up to three (3) alternate potential winners may be determined, after which the applicable prize may not be awarded.
The odds of being selected as a potential winner depend on the total number of entries received during the corresponding Promotion Period.
Release and Limitations of Liability:
Except where prohibited, by participating in the Promotion, entrants agree to release and hold harmless Whistler Water Inc., Polaris Water, World Choice Bottling and their respective parents, subsidiaries, affiliates, promotional partners, prize partners, agents and agencies, and the officers, directors and employees of them (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Promotion or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry, if it is possible. If the Promotion, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the Courts of British Columbia, Canada; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event legal fees or disbursements; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of Province of British Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of British Columbia.
